Abstract:
Governor Andrew M. Cuomo today announced that the U.S. Photovoltaic Consortium (PVMC) and Ceres Technologies, a Hudson Valley-based nanotechnology manufacturer, have launched a $20 million partnership in which Ceres will become one of the first official suppliers of manufacturing equipment to the PVMC. The PVMC is headquartered at the College of Nanoscale Science and Engineering's (CNSE) Albany NanoTech Complex.

Albany, NY | Posted on August 29th, 2012

Lieutenant Governor Robert Duffy today joined officials from CNSE, PVMC, and Ceres Technologies in Saugerties to make the announcement.

Through this collaboration, Ceres projects that more than 250 green energy jobs will be created over the next 5 years, including research and development jobs and facilities and manufacturing jobs (including electrical and mechanical, software, drafting, design engineers, and trades), at its facility and supply chain in Saugerties and Kingston, as well as at CNSE in Albany. To assist this partnership, $764,000 in Excelsior Tax Credits has been awarded to Ceres by Empire State Development through the Mid-Hudson Regional Economic Development Council.

"This significant expansion shows that the investments we have made in nanotechnology research in the Capital Region are generating economic growth and creating jobs across the state," Governor Cuomo said. "This new public-private partnership shows how government is working with the private sector to invest in our state and grow our economy. We look forward to continuing to partner with the private sector to expand nanotechnology in every region of the state."

Lieutenant Governor Robert Duffy said, "By making critical investments in the growing nanotech sector, New York has made the Capital Region and Hudson Valley the place to be for manufacturers of nanotechnology. Governor Cuomo has helped open New York's doors to business, sending a message worldwide that the state stands ready to help facilitate critical partnerships between the public and private sector that create jobs and economic development. This is yet another exciting announcement for New York's growing nanotech industry."

The PVMC is a $400 million consortium for cooperative research and development (R&D) among industry, university, and government partners to accelerate the development, commercialization, and manufacturing of next-generation solar photovoltaic (PV) systems. Through access to world-class programs, talent and advanced manufacturing development facilities at CNSE and SEMATECH, PVMC is a proving ground for innovative solar technologies and manufacturing processes.

Ceres Technologies President and CEO Kevin Brady said, "Ceres Technologies is thrilled to work in collaboration with the College of Nanoscale Science and Engineering to provide advanced solar energy tools and equipment to the U.S. Photovoltaic Manufacturing Consortium. It is exciting to play a key role in the national effort to accelerate the use of green energy in our homes and businesses, and especially to have the opportunity to do so in our own backyard, while growing our high-tech workforce in New York State."

CNSE Senior Vice President and CEO Dr. Alain E. Kaloyeros said, "This partnership between the UAlbany NanoCollege and Ceres Technologies further leverages the pioneering vision and groundbreaking investments made by Governor Andrew Cuomo in next-generation computer chip technologies by continuing to build New York's globally recognized nanotechnology economy. By expanding the critical ecosystem of equipment, tool, and materials' manufacturers and suppliers, while concurrently assembling world-class capabilities in the fast-growing solar energy industry, New York is establishing itself as a magnet for leading global companies who know that innovation is essential to technological and economic success in the 21st century."

Dan Armbrust, CEO of SEMATECH, said, "As a national industry-led consortium, PVMC is pulling together the supply chain to advance solar technologies and manufacturing and accelerate the scale-up and commercialization of low-cost, next generation PV systems. We are excited to partner with Ceres to help introduce advanced thin film deposition equipment into our manufacturing development facility, which is built upon the vision and commitment of the U.S. Department of Energy and New York State."

Doug Hall, PV Manufacturing Initiative Portfolio Manager for the U.S. Department of Energy's SunShot Initiative, said, "These advanced manufacturing tools will enable PVMC to lead the US CIGS module and supply chain community in making critical improvements in the efficiency and cost of next-generation solar technology. These advances driven by PVMC will play an important role in ensuring national competitiveness amid the fast-growing worldwide solar industry."

Senator John J. Bonacic said, "This partnership will bring hundreds of green energy jobs to Saugerties and Kingston; Nanoscale Science and Engineering are the backbone of our State's economic future. This union will undoubtedly advance and strengthen research and development of solar photovoltaics. I am proud that Ulster County's own nanotechnology manufacturer, Ceres Technologies has become the very first official provider of equipment to the PVMC."

Assembly Member Pete Lopez said, "Promoting innovation and technology is critical to the region and the state as a whole if our businesses are to remain competitive across the globe. This partnership between Ceres Technologies and SUNY College of Nanoscale Science and Engineering is one that Governor Cuomo and my office are aggressively working to repeat in the Hudson Valley and beyond. We encourage other businesses to strengthen their relationships with our state and private colleges to build on this effort to create more jobs and opportunities for insuring New York's economic future."

Ceres will join PVMC as a core member and serve as a key partner in establishing an advanced manufacturing development facility at CNSE to enable rapid prototyping of innovative solar devices. In so doing, PVMC is leading the national effort to reduce the cost of installed solar energy systems from $5 per watt to less than $1 per watt over the next 10 years.

Ceres will provide to PVMC two vacuum thin-film deposition tools that are critical for manufacturing advanced solar cell devices on flexible substrates using copper indium gallium selenide, known as CIGS-based PV technologies. These CIGS-based solar cells represent the next generation of solar photovoltaics, offering improved performance at a reduced cost to manufacture and install.

After South Africa police shot miners, miners charged with murder

Mines

Two weeks after dozens of striking miners were shot dead by police in a bloody incident that shocked South Africans, state prosecutors have filed charges -- against?fellow miners.

Authorities charged 270 miners with murder in the slayings of 34 colleagues under a controversial law often used under apartheid, South African media reported Thursday.

?It's the police who were shooting, but they were under attack by the protesters, who were armed, so today the 270 accused are charged with the murders? of those who were shot, National Prosecuting Authority spokesman Frank Lesenyego told the Associated Press.

The decision outraged many South Africans, who argued the law was being abused for political purposes. ?Even if it was true that the miners provoked the police, this could never, ever, make them liable for the killing of their comrades,? University of Cape Town constitutional law expert Pierre de Vos wrote, calling the decision bizarre, shocking and shameful.

The charges lodged by prosecutors are so dubious that they are plainly political, he said. ?They have acted with fear, favor and prejudice to advance some or another political agenda, further eroding the little trust South Africans might still have left in them,? De Vos concluded.

South African police have argued that they had no choice but to fire on the charging armed miners at the Lonmin platinum mine after lesser measures, such as tear gas and rubber bullets, failed to disperse them. The protesting miners had walked off the job to demand higher wages.

Julius Malema, the expelled president of the youth wing of the ruling African National Congress Party, told protesters outside a Pretoria court that the decision was ?madness.?

"The policemen who killed those people are not in custody, not even one of them,? Malema was quoted?by the South African Press Assn. as telling the infuriated crowd.

Under the ?common purpose? doctrine, part of a ?riotous assembly? act adopted in South Africa more than half a century ago, someone who incites or conspires with someone else to commit a crime is guilty of the same crime, as if they committed it themselves. The law was often used in the apartheid era to charge protest leaders for offenses carried out by protesters, De Vos wrote.

(AP) ? The scene outside the childhood home of Michael Jackson resembled a party as fans joined members of the pop star's family for a vigil Wednesday, which would have been his 54th birthday.

Fans danced to Jackson's music prior to the arrival of his children and mother at the house at 2300 Jackson St., where the King of Pop, his siblings and their parents lived until 1969. In the days after Jackson's death in 2009, the singer's admirers piled stuffed animals, flowers and photos outside the tiny home in Gary.

Among those at the Wednesday night vigil was Andrei Tejada, 32, a Chicago veterinary technician student who said she was pleased that Jackson's relatives were attending the event.

"They still remember where they started, and it shows they appreciate where they started. It's a humbling experience to know they are here," said Tejada, who said she visits the Jackson childhood home once a month.

Other events planned by the family in Gary include a dinner Friday and a concert Saturday.

Before the vigil, Jackson's children, 14-year-old Paris and 15-year-old Prince Michael, were given blue "Team Gary" T-shirts by Gary Mayor Karen Freeman-Wilson as they posed for pictures at a casino overlooking Lake Michigan.

"We just want you to know how much he meant to us and the city of Gary," the mayor said.

Paris and Prince Michael didn't speak during the brief presentation. Later, in the moments before the vigil was to start, the two, joined by Jackson's other child, Prince Michael II, signed autographs outside the Jackson home. A large crowd formed around them, with fans shoving books and posters in the teens' faces.

Jackson's sister LaToya told the crowd the family's musical fame started in the city, east of Chicago, and in "this little house." After saying, "We all love you, Michael," LaToya folded her hands and looked to the sky.

Rainbow/PUSH Coalition leader the Rev. Jesse Jackson showed up at the tribute, stopping in the crowd before the vigil to pose for a photo with a Michael Jackson impersonator.

Jackson later said he thanked God for Michael Jackson and led the crowd in chanting, "Long live Michael!"

Michael Jackson spent the first 11 years of his life in Gary. The family moved out of the city known for its steel mills after the Jackson 5 struck it big in 1969 with the release of their first album.

Aside from two concerts the Jackson 5 played at West Side High School in 1971, the only time the singer returned to his hometown was in 2003, when plans for a Michael Jackson Performing Arts Center in the city's downtown were announced. It was never built.

"Gary, you are family, you always will be, I love you," Jackson said at the time.

Last week, a Los Angeles judge appointed the pop star's nephew, TJ Jackson, to share guardianship responsibilities for the late singer's three children with family matriarch Katherine Jackson. TJ Jackson was appointed a temporary guardian last month when Katherine Jackson was incommunicado during a stay at an Arizona spa with relatives.

Other family members have said Katherine Jackson was being improperly influenced regarding custody arrangements for the children, but her attorney disputed those claims.

Yahoo fires bureau chief for Romney remark

(AP) ? Yahoo News has fired its Washington bureau chief after he was caught on a microphone saying Mitt Romney and his wife were "happy to have a party with black people drowning."

Company spokeswoman Anne Espiritu said Wednesday that David Chalian's remark was inappropriate and does not represent Yahoo's views. She says Yahoo is apologizing to the Republican presidential candidate and his supporters, and has reached out to the campaign to convey the message.

Chalian made the remark during a "hot mic" moment before Yahoo began its live coverage of the GOP convention on Tuesday evening. Yahoo is streaming coverage in association with ABC News.

The remark is an apparent reference to the GOP convention happening as Hurricane Isaac hits the Louisiana coast.

Decline in breeding chinstrap penguins in Antarctic Peninsula confirmed

ScienceDaily (Aug. 29, 2012) ? In a paper published this week in the journal Polar Biology, researchers from the Antarctic Site Inventory confirm significant declines in the breeding population of chinstrap penguins in the vastly warming Antarctic Peninsula, where it's warming faster than, or as fast as, any other place on Earth.

New results and analyses stem from fieldwork conducted in December 2011 at Deception Island, one of the most frequently visited locations in Antarctica.

Overseen by Ron Naveen, founder of the nonprofit science and conservation organization, Oceanites, Inc., the Deception Island census effort analyses were undertaken by Dr. Heather Lynch, Assistant Professor of Ecology and Evolution at Stony Brook University, and chief scientist of the Antarctic Site Inventory project.

The Inventory has been collecting and analyzing Antarctic Peninsula-wide penguin population data since 1994, and these new findings have important implications both for the advancement of Antarctic science and the management of Antarctica by the Antarctic Treaty nations.

"Our Deception Island work, using the yacht Pelagic as our base, occurred over 12 days and in the harshest of conditions -- persistent clouds, precipitation, and high winds, the latter sometimes reaching gale force and requiring a lot of patience waiting out the blows," said Naveen. "But, in the end, we achieved the first-ever survey of all chinstraps breeding on the island."

The other Inventory researchers on the team were Steven Forrest (Oceanites, Inc.), Dr. Thomas Mueller (Biodiversity and Climate Research Centre), and Dr. Michael Polito (now at Woods Hole Oceanographic Institute). The scientific effort of the Inventory is supported by the U.S. National Science Foundation and public contributions, and the project's on-the-ground fieldwork at Deception Island was specifically supported by a grant from The Tinker Foundation. The Inventory is the only publicly supported science project working in Antarctica and the only science project tracking penguin populations throughout the entire Antarctic Peninsula region.

Deception Island is frequently visited and there has been speculation that tourism may have a negative impact on breeding chinstrap penguins -- especially, at Deception Island's largest chinstrap colony known as Baily Head. Previously, Antarctic Treaty-level discussions regarding the management of visitors at Baily Head proceeded in the absence of concrete site-wide census data.

The results and analyses, according to Dr. Lynch, shed new light on the massive changes occurring in this region.

"Our team found 79,849 breeding pairs of chinstrap penguins at Deception, including 50,408 breeding pairs at Baily Head. Combined with a simulation designed to capture uncertainty in an earlier population estimate, there is strong evidence to suggest a significant (>50%) decline in the abundance of chinstraps breeding at Baily Head since 1986/87.

"The decline of chinstrap penguins at Baily Head is consistent with declines in this species throughout the region, including at sites that receive little or no tourism; further, as a consequence of regional environmental changes that currently represent the dominant influence on penguin dynamics, we cannot ascribe any direct link in this study between chinstrap declines and tourism."

The Baily Head analysis was abetted by Dr. Lynch's cutting-edge analyses of high-resolution satellite imagery. Images were available for the 2002/03 and the 2009/10 seasons that suggest a 39% decline over that seven-year period, and which provide independent confirmation of this population decline. Via assistance from the U.S. National Science Foundation and a cooperative effort the University of Minnesota's Polar Geospatial Center, the Inventory continues to demonstrate the use of satellite imagery to analyze and describe environmental change in sensitive habitats.

"We now know," says Naveen, "that two of the three predominant penguin species in the Peninsula -- chinstrap and Ad?lie -- are declining significantly in a region where, in the last 60 years, it's warmed by 3? C. (5? F.) annually and by 5? C. (9? F.) in winter. By contrast, gentoo penguins, the third of these species, are expanding both its numbers and range. These divergent responses are an ongoing focus of our Inventory work effort."

Adds Lynch: "While there has been considerable focus in the policy and management community about the potential impact of tourism on these penguin populations, we cannot forget the overwhelming evidence that climate is responsible for the dramatic changes that we are seeing on the Peninsula. If tourism is having a negative impact on these populations, it's too small an effect to be detected against the background of climate change."

'Anternet' discovered: Behavior of harvester ants as they forage for food mirrors protocols that control Internet traffic

ScienceDaily (Aug. 28, 2012) ? On the surface, ants and the Internet don't seem to have much in common. But two Stanford researchers have discovered that a species of harvester ants determine how many foragers to send out of the nest in much the same way that Internet protocols discover how much bandwidth is available for the transfer of data. The researchers are calling it the "anternet."

Deborah Gordon, a biology professor at Stanford, has been studying ants for more than 20 years. When she figured out how the harvester ant colonies she had been observing in Arizona decided when to send out more ants to get food, she called across campus to Balaji Prabhakar, a professor of computer science at Stanford and an expert on how files are transferred on a computer network. At first he didn't see any overlap between his and Gordon's work, but inspiration would soon strike.

"The next day it occurred to me, 'Oh wait, this is almost the same as how [Internet] protocols discover how much bandwidth is available for transferring a file!'" Prabhakar said. "The algorithm the ants were using to discover how much food there is available is essentially the same as that used in the Transmission Control Protocol."

Transmission Control Protocol, or TCP, is an algorithm that manages data congestion on the Internet, and as such was integral in allowing the early web to scale up from a few dozen nodes to the billions in use today. Here's how it works: As a source, A, transfers a file to a destination, B, the file is broken into numbered packets. When B receives each packet, it sends an acknowledgment, or an ack, to A, that the packet arrived.

This feedback loop allows TCP to run congestion avoidance: If acks return at a slower rate than the data was sent out, that indicates that there is little bandwidth available, and the source throttles data transmission down accordingly. If acks return quickly, the source boosts its transmission speed. The process determines how much bandwidth is available and throttles data transmission accordingly.

It turns out that harvester ants (Pogonomyrmex barbatus) behave nearly the same way when searching for food. Gordon has found that the rate at which harvester ants -- which forage for seeds as individuals -- leave the nest to search for food corresponds to food availability.

A forager won't return to the nest until it finds food. If seeds are plentiful, foragers return faster, and more ants leave the nest to forage. If, however, ants begin returning empty handed, the search is slowed, and perhaps called off.

Prabhakar wrote an ant algorithm to predict foraging behavior depending on the amount of food -- i.e., bandwidth -- available. Gordon's experiments manipulate the rate of forager return. Working with Stanford student Katie Dektar, they found that the TCP-influenced algorithm almost exactly matched the ant behavior found in Gordon's experiments.

"Ants have discovered an algorithm that we know well, and they've been doing it for millions of years," Prabhakar said.

They also found that the ants followed two other phases of TCP. One phase is known as slow start, which describes how a source sends out a large wave of packets at the beginning of a transmission to gauge bandwidth; similarly, when the harvester ants begin foraging, they send out foragers to scope out food availability before scaling up or down the rate of outgoing foragers.

Another protocol, called time-out, occurs when a data transfer link breaks or is disrupted, and the source stops sending packets. Similarly, when foragers are prevented from returning to the nest for more than 20 minutes, no more foragers leave the nest.

Prabhakar said that had this discovery been made in the 1970s, before TCP was written, harvester ants very well could have influenced the design of the Internet.

Gordon thinks that scientists have just scratched the surface for how ant colony behavior could help us in the design of networked systems.

There are 11,000 species of ants, living in every habitat and dealing with every type of ecological problem, Gordon said. "Ants have evolved ways of doing things that we haven't thought up, but could apply in computer systems. Computationally speaking, each ant has limited capabilities, but the collective can perform complex tasks.

"So ant algorithms have to be simple, distributed and scalable -- the very qualities that we need in large engineered distributed systems," she said. "I think as we start understanding more about how species of ants regulate their behavior, we'll find many more useful applications for network algorithms."

The work is published in the Aug. 23 issue of PLoS Computational Biology.

WorkLife Essentials: In September in WorkLife Essentials - Fatherhood

We are very happy to note that there are ongoing efforts to recognize the important and unique role that fathers play in their children?s lives. While it is difficult to quantify the precise impact that a more involved father has on his children, numerous studies agree that the greater the involvement, the greater the benefit to children.

One of the more recent studies by The National Center for Fathering (link below), shows that over a ten year period from 1999 to 2009, fathers' involvement in their children's studies is increasing across every single aspect surveyed. Over the same timeframe, however, a study by The Office for National Statistics in the UK reported survey results showing that mothers still provided 75% of the time spent on Childcare in the average home. ?So, clearly there is more room for fathers to be involved in their children's lives and you can read all about the many related topics in this month's Promotion inside WLE.com.

If you aren't a father yet, get started by reading about becoming a father whether it be through birth, adoption or marriage. Or, if you already are, find out what particular attention they need from their father during various life stages - from infancy (in the article we?ve highlighted below) through toddler, school age years, teenage years and even after they?ve left the home.
We also have resources on how to deal with other aspects of being a father, like talking to your children about the world, sharing household responsibilities and maintaining good work life balance to allow you to connect with your children at even the most stressful times (another article highlighted below). We even have multimedia audio tracks about being a father that cover a range of relevant topics.
Lastly, share your experiences with us this month in a short survey on your involvement in your child?s education. Just click here to start!
As always, connect with us and your fellow WLE users on our Blog, where you can search through our archive of promotional topics and bonus resources in multiple languages. For support, we would love to help with any comments or feedback - just email us at Support@WorkLifeEssentials.com.

Survivor of flesh-eating disease to visit 'Katie'

NEW YORK (AP) ? Katie Couric says a guest on her upcoming talk show will be Aimee Copeland, the Georgia woman who survived a rare flesh-eating disease.

Copeland, a 24-year-old grad student, will be interviewed on Couric's new show, "Katie," airing Sept. 11. The show announced Tuesday that with the help of her prosthetics, Copeland will walk onto the stage.

Copeland contracted the rare infection in May after falling from a zip line and gashing her leg. Doctors had to amputate both hands, her left leg and right foot. She returned home last week after three months in the hospital and a rehabilitation clinic.

Still facing a rigorous recovery process, Copeland will discuss her story of survival.

Airing weekdays, the syndicated "Katie" premieres Sept. 10, when its guests will include Jessica Simpson and Sheryl Crow.

Mayweather associate gets prison in Vegas shooting

LAS VEGAS (AP) ? An associate of Floyd Mayweather Jr. was sentenced Tuesday to two to five years in prison for shooting at two men in a car after they argued with the champion boxer at a Las Vegas skating center.

Ocie Harris, 30, of Chicago could have faced up to 18 years in prison after pleading an equivalent of no contest to three felony charges in the Aug. 23, 2009, shooting outside Crystal Palace Skate Center.

Prosecutor Samuel Bateman sought a 12-year sentence, arguing it was clear that Harris and Mayweather were associates and friends, and that Harris shot seven times in the crowded parking lot at a BMW sedan with two people inside.

Six shots hit the vehicle, but driver Damein Bland and passenger Quincey Williams were not wounded.

Clark County District Court Judge Douglas Herndon chose to run Harris' sentences concurrently and credited him with a month of time served. Harris also was ordered to pay almost $24,000 in restitution.

Mayweather wasn't charged in the case. His lawyers didn't immediately respond Tuesday to a message seeking comment.

Defense lawyer Tom Pitaro argued that prosecutors tried to pressure Harris to implicate the 35-year-old Mayweather in the incident.

Police said the dispute was about a text message Williams sent to Mayweather, saying he hoped the boxer would lose an upcoming fight.

Police claimed Mayweather threatened Williams by saying he could have him "trumped."

"Ocie Harris had no reason to shoot at these two people other than the beef they had with Floyd Mayweather," prosecutor Bateman said.

Harris avoided trial with his Alford plea in April. He didn't admit guilt but acknowledged that prosecutors could prove two counts of assault with a deadly weapon and one charge of firing a weapon into a vehicle.

Prosecutors dropped two attempted murder charges and one felony weapon charge as part of the plea agreement.

A separate civil lawsuit alleging Mayweather orchestrated the attack seeks monetary damages for Bland and Williams. The case is pending in Clark County District Court, with trial scheduled next July.

Mayweather's manager, Leonard Ellerbe, has characterized the lawsuit as an attempt to extort money from Mayweather and denied that he was involved in the shooting.

Police seized handguns, ammunition, bulletproof vests and two vehicles from Mayweather's home after the skate center shooting, but did not find the gun believed to have been used in the shooting.

Mayweather acknowledged being at the skating center but denied knowing anyone named Ocie and having any knowledge of a shooting. His lawyer, Richard Wright, said at the time that Mayweather was at the rink with his children, and the guns seized from his home were taken from security guards and registered to them.

Mayweather got out of jail earlier this month in Las Vegas after serving two months of a delayed 90-day sentence following his guilty plea last December in a September 2010 domestic battery case.

Mayweather was named by Forbes magazine as the world's highest-paid athlete for 2011. He is undefeated as a boxer and was guaranteed $32 million for a May 5 bout when he defeated Miguel Cotto.

Peterson lawyers mount defense at murder trial

JOLIET, Ill. (AP) ? Drew Peterson's defense team began Monday to try to counter the state's portrayal of the former suburban Chicago police officer as a bully who is more than capable of slaying his third wife.

Prosecutors rested their four-week, 30-plus witness case earlier on Monday, ending with a dramatic letter from the alleged victim, in which Kathleen Savio said she feared her spouse would kill her.

Peterson, now 58, has pleaded not guilty to first-degree murder in Savio's 2004 death. The former Bolingbrook police sergeant was only charged after his fourth wife, Stacy Peterson, went missing in 2007.

In her frantic 2002 letter to a Will County prosecutor, Savio accused her estranged husband of breaking into her house and putting a knife to her throat.

"He asked me several times if I was afraid," according to the letter, which was written during acrimonious divorce proceedings. "I started to panic. He pulled out his knife that he kept around his leg and brought it to my neck. I thought I'd never see my boys again."

Two years later, Savio, 40, was found dead in a bathtub at her home with a gash on the back of her head. Her death was initially deemed accidental but reclassified a homicide after Stacy Peterson disappeared.

Before he was arrested and jailed in 2009, the swaggering Drew Peterson went on a media blitz to declare his innocence. His legal defense started in earnest Monday in front a jury clad in various sports jerseys, one of their many dress-alike stunts.

If Peterson is convicted, he faces a maximum 60-year prison term.

The defense's first witness was Mary Pontarelli, a neighbor and close friend of Savio's who also had testified for the state about finding Savio's body. Pontarelli conceded Monday she never saw Peterson strike Savio or even raise his voice at her.

"He was very respectful ... a good neighbor," she said. "He's a funny guy, he makes jokes about things ? not in a mean way."

She also told jurors Savio would have fought back if attacked. The defense has said the absence of defensive wounds on Savio bolstered their contention she died accidentally.

"She's tough," Pontarelli agreed. "She wouldn't let someone hit her without her hitting back."

Rob Sud, a Bolingbrook police officer who went to Savio's house the night her body was found, also testified Monday. He said he saw nothing in house to raise his suspicions that her death was anything but accidental.

"There wasn't some grand conspiracy to cover something up was there?" defense attorney Steve Greenberg asked, though a judge sustained an objection before the officer could answer.

After prosecutors rested Monday morning, Judge Edward Burmila rejected a defense request that he acquit Peterson even before the case goes to jurors. To grant a directed verdict ? which are commonly asked for, but rarely granted ? he would have had to conclude that the state fell so far short of proving their case there was no need to go on.

"We have no theory about what happened to this lady?" Greenberg said in arguing for the motion, his voice rising. "There's nothing, here! ... They just hope this jury or your honor dislikes Drew Peterson ? so let's presume he did it."

Without any physical evidence following a botched initial investigation, prosecutors had to rely heavily on hearsay evidence, mostly comments that Savio made before she died and that Stacy Peterson made before she vanished.

Hearsay ? statements not based on a witness's direct knowledge ? is normally barred in trials in the United States, but Illinois passed a law tailored to Peterson's case, dubbed "Drew's Law," allowing hearsay in rare circumstances.

Peterson attorney Joel Brodsky told reporters Monday the defense intends to call to the stand the eldest of Savio's and Peterson's two sons, Tom Peterson, to "tell what he knows about his father's innocence." The recent high school graduate is expected to testify Wednesday.

Defense attorneys also told the judge they want to put Savio's divorce lawyer, Harry Smith, on the stand, in a bid to dent the credibility of hearsay related to Stacy Peterson. Burmila will decide Tuesday if Smith will be allowed to say Peterson called him in 2007 to ask if she could squeeze Drew Peterson for money by threatening to tell police he killed Savio.

(AP) ? A young South African adventurer seeking to follow the Amazon River from its origin to its mouth was in stable condition in a Lima hospital Monday after being shot and robbed by a pair of youths while on a Peruvian tributary, authorities said.

David du Plessis, 24, was shot three times by two young men Saturday while kayaking down the Ucayali River near the provincial capital of Pucallpa, said his father, Louis du Plessis.

"They set up an ambush and they shot him from the woods," he said. The first shot knocked the young man from the kayak, the second hit him as he headed for shore and the third when he reached shore, his father said.

"He realized the only way he could get away was to run" so he ran about three miles (5 kilometers) despite internal bleeding and a neck wound that would interfere with his speech when he arrived in a village wearing only swimming shorts and a T-shirt, said his father, who flew from the United States to be with him.

The young adventurer, who began his journey in late June, was taken downriver in a motorized canoe and arrived in Pucallpa after dusk, said Margot Sanchez, whose brother speaks some English and alerted du Plessis' mother by phone.

"He was losing a lot of blood," said Sanchez.

"Our son is lucky to survive. It was 10 hours before he got to hospital," said the young man's mother, Robyn Wolff, from Durban, South Africa.

David du Plessis was flown to Lima on Sunday, thanks in part to employees of the local subsidiary of the beverage company SABMiller, his parents said.

He was in intensive care at the Anglo-American Hospital. The hospital's medical director, Dr. Edgar Tejada, said he was in stable condition.

David du Plessis has temporarily lost some hearing, had to have fluid drained from one lung and apparently has a pellet lodged in or near his heart, said his father, a U.S.-based yacht captain retired from the South African navy.

"If he had gotten shot with anything other than a shotgun he would not be here with us. He is very, very lucky," said Louis du Plessis.

The regional police commander in Pucallpa, Col. Cesar Augusto Larrea, told The Associated Press that investigators had gone upriver to try to locate the assailants but had so far made no arrests.

He said he did not know exactly where it happened: "There are a lot of small villages up there."

Larrea said it was not the first such attack on a foreigner in the area.

In May 2011, a Polish couple was slain while kayaking in the same region, their bodies found in the Ucayali. Police said their belongings had been divided among the three farmers arrested on suspicion of killing them.

Wolff said her son had obtained a permit from the Peruvian military before entering the zone where he was attacked and that the military had warned him that it was a dangerous area. After she learned from Sanchez's brother that her son had been shot, Wolff turned to his Facebook page, "World Wonderer ? The Amazon," to seek help in organizing his evacuation to Lima.

Louis de Plessis said his son had traveled last year by bicycle from Cairo, Egypt, to South Africa.

Before heading down the river, David du Plessis climbed Peru's 18,363-foot (5,597-meter) Mount Mismi, which some explorers say is the most distant source of the Amazon River, according to his blog. It said he reached the summit in late July.

His father said he had planned to join his son, known as "Davey," on the Amazon from Iquitos, Peru, to Manaus, Brazil.

2 Pussy Riot members flee Russia to escape arrest

MOSCOW (AP) ? Two members of the punk band Pussy Riot have fled Russia to avoid prosecution for a protest against Vladimir Putin that sent three of their band mates to prison, the group said Sunday.

Five members of the feminist group took part in a provocative performance inside Moscow's main cathedral in February to protest the Russian leader's rule and his cozy relationship with the Orthodox Church. The women wore their trademark garishly colored balaclavas, which made it difficult for police to identify them, and only three were arrested.

After a controversial trial that highlighted Putin's crackdown on dissent since he began a third presidential term in May, the three band members were convicted of hooliganism and sentenced to two years in prison on Aug. 17. Days later, Moscow police said they were searching for the other band members, an apparent warning to the group to stop its anti-Putin protests.

Even as the judge was reading the verdict in a Moscow courtroom, one of the band members who had escaped arrest played Pussy Riot's latest song, "Putin sets the fires of revolutions," from the balcony of an apartment building across the street.

Pussy Riot tweeted on Sunday that the two activists had fled Russia and are "recruiting foreign feminists to prepare new protest actions." No mention was made of where they went.

At least 12 other members of the group remain in Russia, another message on Twitter said.

Botched fresco repair becomes tourist attraction

By now, you've probably seen the pictures out of Spain of the 19 century painting of Jesus that was "restored" by a local grandmother after decades of damage and neglect. In the wake of her botched restoration, the picture has become a sensation, spawning some hilarious parodies around the Internet. NBC News' Duncan Golestani reports.

By Duncan Golestani, NBC News

She became a viral Internet sensation last week, mocked for her botched restoration of a century-old fresco at her local church - but Cecila Giminez has still attracted a few fans.

Flowers are being left outside the elderly woman?s home in the village of Borja, north-eastern Spain, and the damaged painting has suddenly become a tourist attraction.

The 19th-century fresco, which used to depict Jesus until Giminez?s misguided intervention, is attracting so many tourists that it has now been roped off and is watched over by a security guard.

Tens of thousands of people have signed an online petition praising Giminez?s restoration as a ?daring work? and even as ?endearing and loving act, a clever reflection of the political and social situation of our time?.

The family of the painter, Elias Garcis Martinez, does not see it that way ? especially as they had just agreed to make a donation to have the painting professionally restored.

I can paint that! Wait, no I can't! Amateur artist messes up century-old artwork

''Until now she just painted on the tunic but the problem started when she painted the head as well, because she has destroyed this painting,'' the artist?s granddaughter Teresa Garcia told Spanish television.

Giminez, who is in her 80s, said she was trying to improve the artwork, which had become damaged by moisture, and insisted she had the permission of the priest.

A team of art restoration experts is reportedly examining the painting, will quiz Giminez on what materials she used in her attempt and will figure out how best to?proceed.?

In the meantime, the restoration has been mocked in a series of Internet parodies including a fake Twitter account.
